Updated Fair Work Information Statement - December 2019

The Fair Work Information Statement (FWIS) has been amended to reflect the outcome of a recent Federal Court Decison.

Effective December 2019,  an updated Fair Work Information Statement (FWIS) has been issued. Normally revised in June each year, the December update reflects the outcome of a Federal Court Decision confirming the correct method for accruing and taking paid personal/carer’s leave under the National Employment Standards. An appeal of this decision will be heard by the High Court this year, however in the meantime, the decision made in August 2019 is the current state of the law and applies.

The case concerned the meaning of “day” in the context of the 10 days personal/carer’s leave permanent employees are entitled to. The claim was brought on behalf of shift workers, who worked three shifts of 12 hours per week.

Just a reminder that under the National Employment Standards, employers must give every new employee a FWIS before, or as soon as possible after, the employee starts working for them.

Employers should keep a record of the date that the FWIS is provided and whether it is handed personally to the employee, emailed or mailed.
